Agreement to Terms

By accessing or using Tappd ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

Description of Service

Tappd is a B2B SaaS platform that provides:

• Push Notifications - Send push notifications to mobile and web applications
• In-App Messages - Display in-app content cards and messages
• Journey Builder - Create automated customer journey workflows
• Customer Data Platform - Unify and manage customer profiles and data
• Analytics - Track events, sessions, and engagement metrics
• API & SDKs - RESTful APIs and SDKs for web and mobile integration

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

Account Registration

To use Tappd, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use
• Be at least 18 years old or have parental consent

You may create workspaces and invite team members. You are responsible for managing workspace access and ensuring all team members comply with these Terms.

Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy. You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.

Payment Terms

Subscription Plans: Tappd offers various subscription plans with different features and usage limits. Pricing is available on our pricing page and may change with notice.

Payment Processing: Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for all fees associated with your subscription.

Billing Cycle: Subscriptions are billed monthly or annually based on your selected plan. Fees are charged in advance for each billing period.

Refunds: All fees are non-refundable. You may cancel your subscription at any time, and you will continue to have access until the end of your current billing period.

Price Changes: We reserve the right to change our pricing with 30 days' notice. Price changes will apply to your next billing cycle.

Overages: If you exceed your plan's usage limits, we may charge overage fees or suspend your account until you upgrade your plan.

Intellectual Property

Our Rights: The Service, including all content, features, functionality, and software, is owned by [Company Name] and protected by copyright, trademark, and other intellectual property laws.

Your Rights: You retain all rights to your customer data and content. By using the Service, you grant us a limited license to use, store, and process your data solely to provide the Service.

SDK License: Our SDKs are provided under the terms specified in our SDK End User License Agreement, which is incorporated into these Terms by reference.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPPD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Termination

By You: You may cancel your account at any time through your account settings or by contacting support. Upon cancellation, your subscription will remain active until the end of your current billing period.

By Us: We may suspend or terminate your account immediately if you violate these Terms, our Acceptable Use Policy, or engage in fraudulent or illegal activity.

Effect of Termination: Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data after a reasonable retention period
• You remain responsible for all fees incurred prior to termination
• Provisions that by their nature should survive termination will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Haryana, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Haryana.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
